Messangi Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) describes the rules that apply to any party (“Customer” or “you”) using any services or products (“Services”) provided by Messangi Corporation or its affiliates (“Messangi”), including but not limited to APIs, platforms, communications channels, and mobile messaging infrastructure. This AUP also applies to any user of any software application or service made available by Customer that interfaces with Messangi’s Services (“End Users”).

The examples described in this AUP are not exhaustive. Messangi may modify this AUP at any time by posting a revised version on its website or notifying customers directly. Continued use of the Services after an update constitutes acceptance of the new terms.

1. Overview and Objective

Messangi is committed to providing a secure, compliant, and reliable environment for messaging and communication. This AUP establishes guidelines for proper use to protect the Services, ensure compliance with applicable law, and maintain the integrity of messaging ecosystems, including SMS, WhatsApp, Email, RCS, Push Notifications, and Voice communications.

By using Messangi’s Services, you agree not to misuse the Services or help anyone else do so.

2. Prohibited Content

Customers and End Users must not use the Services to transmit, store, display, distribute, or otherwise make available any content that:

  • Is unlawful, obscene, defamatory, harassing, abusive, or threatening
  • Promotes or incites violence, terrorism, hate speech, or discrimination
  • Violates applicable intellectual property or privacy rights
  • Includes false, misleading, or deceptive content, including impersonation
  • Contains or promotes scams, phishing, fraud, pyramid schemes, or malicious links
  • Is intended to sexually exploit minors or promote illegal activities

Prohibited content also includes any communication or materials originating from hate groups or individuals promoting criminal misinformation or dangerous movements.

3. Messaging-Specific Restrictions

The following rules apply specifically to messaging traffic (e.g., SMS, MMS, RCS, WhatsApp, Email, Voice):

  • Unsolicited Messaging (Spam): Sending promotional or commercial messages without valid, documented user consent is prohibited. You must obtain opt-in consent from each recipient prior to sending marketing or bulk messages.
  • Opt-Out Compliance: You must include clear instructions for recipients to opt out and respect all opt-out requests promptly. This includes STOP keywords and country-specific rules.
  • Traffic Obfuscation: Snowshoeing, number cycling, or spreading large volumes across multiple sender IDs to bypass filtering or restrictions is prohibited.
  • Unauthenticated Messaging: Sending messages through unregistered, spoofed, or unauthorized numbers or display names is strictly forbidden.
  • 10DLC Campaign Registration (U.S.): All 10DLC traffic in the United States must be registered through The Campaign Registry (TCR), including brand vetting and approved campaigns. Customers must not send unregistered traffic.
  • Carrier Restrictions: You must follow messaging guidelines from CTIA, GSMA, mobile operators, and third-party aggregators. Noncompliance may result in message filtering, fines, or suspension.

4. Technical and Platform Misuse

You may not:

  • Attempt to probe, scan, penetrate, reverse-engineer, or test the vulnerability of any Messangi systems
  • Use the Services to perform or support denial-of-service (DoS) attacks
  • Bypass or defeat rate-limiting, authentication, or anti-spam mechanisms
  • Introduce viruses, worms, malware, spyware, or code intended to harm, intercept, or alter functionality
  • Use automation, bots, or scripts to abuse the platform or gain unauthorized access

5. Data Privacy and Security

You are responsible for ensuring your use of the Services complies with applicable data protection and privacy laws, including:

  • GDPR (EU/EEA)
  • CCPA/CPRA (California)
  • LGPD (Brazil)
  • PIPEDA (Canada)
  • HIPAA (if applicable in healthcare scenarios)

Specifically:

  • You must collect, store, and transmit personal data lawfully, with proper consent where required
  • You must not use the Services to collect personal data without notifying individuals
  • You must protect credentials and access keys to the platform and notify Messangi immediately in case of a breach

6. Compliance with Legal and Industry Standards

You may not use the Services in violation of:

  • Any applicable local, national, or international law or regulation
  • CTIA Messaging Principles and Best Practices (USA)
  • Mobile Marketing Association (MMA) Code of Conduct
  • Applicable telecommunication carrier requirements

Customers using Services in the United States must adhere to FCC and TCPA regulations.

7. Enforcement and Violations

Messangi reserves the right to:

  • Investigate any violation of this AUP or misuse of the Services
  • Suspend or terminate access without prior notice if Customer or End User behavior poses a risk to the platform, other users, or compliance
  • Block specific sender IDs, numbers, campaigns, or destinations
  • Notify mobile carriers, regulators, or law enforcement where required
  • Request records of opt-in or customer communications to verify compliance

Repeated or egregious violations may result in permanent suspension or legal liability.

8. Reporting Violations

If you become aware of any violation of this AUP or misuse of the Services, please report it immediately to:

Customers are expected to cooperate with any investigation initiated by Messangi or its partners.

9. Updates and Modifications

Messangi may update this AUP at any time. Changes will become effective upon posting or notification to customers. Customers are responsible for reviewing the AUP periodically and complying with the most recent version.

10. Examples of Permissible Use

The following uses are generally permitted with proper consent and legal compliance:

  • Transactional alerts (e.g., receipts, account notices)
  • Two-factor authentication and verification codes
  • Customer support notifications
  • Promotional messages with user opt-in
  • Regulatory announcements or emergency alerts
